Terms of Service

Lapsus is made by Synaptic Mishap, a sole trader registered in the UK. Synaptic Mishap provides Lapsus and its related services (“Service”) subject to your compliance with the terms and conditions (“Terms of Service”) set forth below. Please read the following carefully. Synaptic Mishap reserves the right to update and modify the Terms of Service at any time without notice. New features that may be added to the Service shall be subject to the Terms of Service. Should you continue to use the Service after any such modifications have been made, this shall constitute your agreement to such modifications.

Description of Service

Lapsus is a computer-based time-tracking application from Synaptic Mishap. Your use of the Service is at your sole risk. The service is provided on an AS IS and AS AVAILABLE basis.

Eligibility

You must be at least thirteen (13) years of age to use this Service. You must provide your current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service.

Proper Use

You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to:

  • use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably determined by Synaptic Mishap;
  • use the Service for any fraudulent or inappropriate purpose;
  • resell, duplicate, reproduce or exploit any part of the Service without the express written permission of Synaptic Mishap;
  • use any robot, spider, other automated device, or manual process to monitor or copy any content from the Service.

Violation of any of the foregoing may result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences.

Payment Terms

A single one-off payment will be required to purchase a single licence of Lapsus. Each licence purchased is to be used on one machine only. The cost for this application can be increased or decreased at any time without prior notification.

Intellectual Property Rights

Synaptic Mishap own the intellectual property rights to any and all protectable components of the Service, including but not limited to the name of the Service, artwork and end-user interface elements contained within the Service, many of the individual features, and the related documentation. You may not reverse engineer, decompile, copy, modify, adapt, reproduce, distribute or dissemble any aspect of the Service which Synaptic Mishap owns.

Warranties and Liability

Synaptic Mishap makes no warranties regarding (i) your ability to use the Service, (ii) your satisfaction with the Service, (iii) that the Service will be available at all times, uninterrupted, and error-free (iv), the accuracy of mathematical calculations performed by the Service, and (v) that bugs or errors in the Service will be corrected.

Synaptic Mishap are not responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service.

If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.

The failure of Synaptic Mishap to exercise any right provided for herein shall not be deemed a waiver of any right hereunder. The Terms of Service sets forth the entire understanding between you and Synaptic Mishap as to the Service and supersedes any prior agreements between you and Synaptic Mishap (including, but not limited to, prior versions of the Terms of Service).
